For every tree protected by these specifications, which is removed or, in the opinion of the engineer, is unduly damaged by the contractor, the contractor shall pay a penalty of ****, 00 per tree to the employer.
Failure to submit the required health and safety documentation with the tender will lead to the conclusion that the contractor will not be able to carry out the work under the contract safely in accordance with the construction regulations.
