The bid notice states that 30 days payment terms and conditions of the invoices will be applicable after the delivery of goods and services to the municipality.

The General Conditions of Contract (GCC) clause 22 states that if the supplier fails to deliver any or all of the goods or to perform the services within the periods specified in the contract, the purchaser shall, without prejudice to its other remedies under the contract, deduct from the contract price, as a penalty, a sum calculated on the delivered price of the delayed goods or unperformed services using the current prime interest rate calculated for each day of the delay until actual delivery or performance.

The service provider warrants that it is duly organized, registered, and existing under the laws of South Africa, has the necessary skills and qualifications, and that the contract will constitute legal, valid, and binding obligations.

Tenders will be evaluated in four stages: responsiveness, financial and preferential evaluation (80/20 or 90/10 system), and risk analysis. Final award will be based on the best value for money, risk allocation, and risk profile of the bidder.

Bidders must attend compulsory briefing sessions, submit all compulsory returnable schedules and documents, and meet specific prequalifying criteria related to experience and professional registration.

A daily penalty of 1. 00% of the contract price, up to a maximum of 15% of the contract price, may apply if a specific delivery date is agreed upon and not met. The employer may also terminate the contract if penalties are exhausted.

A compulsory onsite briefing session is scheduled for March 11, 2026, at 11:00 CAT at the corner of Sydney and Rick Turner Francois Road, Congella.

The cutoff date for tender queries is March 16, 2026, at 16:00 Telkom time.
